Terms of Service

Agreement to Terms

By downloading, installing, or using the Capsl application ("Capsl," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Capsl. We may update these Terms from time to time; continued use after changes constitutes acceptance.

Description of Service

Capsl is a time capsule app that allows you to create shared capsules with friends and family. You add photos and videos to a capsule, set a reveal date, and invite others to contribute. On the reveal date, the capsule unlocks for all participants. We provide the platform; you are responsible for your content and conduct.

Account Registration and Eligibility

To use Capsl, you must:

  • Be at least 13 years of age (or the age of consent in your jurisdiction)
  • Provide accurate account information when signing in with Google or Apple
  • Maintain the security of your account and notify us of any unauthorized access
  • Not create multiple accounts for abusive purposes

Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Infringe any third party's intellectual property, privacy, or other rights
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the service for spam, phishing, or unauthorized commercial purposes
  • Attempt to gain unauthorized access to our systems, other accounts, or capsule content
  • Interfere with or disrupt the service or servers
  • Use automated means (bots, scrapers) to access the service without permission

We reserve the right to remove content and suspend or terminate accounts that violate these rules.

Your Content and Licenses

You retain ownership of the content you upload to Capsl. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to store, display, and transmit your content solely to provide the Capsl service (e.g., showing your photos to capsule participants on the reveal date). You represent that you have the right to grant this license and that your content does not violate any third-party rights.

Content shared within a capsule is visible to all invited participants. Do not add content you do not want others in the capsule to see.

Premium Subscriptions and Payments

Capsl may offer premium features through in-app purchases. If you subscribe:

  • Payment: Payments are processed through the Apple App Store or Google Play Store. You agree to their respective payment terms.
  • Renewal: Subscriptions typically auto-renew unless cancelled before the renewal date. You can manage or cancel subscriptions in your device's app store settings.
  • Refunds: Refund requests are handled by Apple or Google according to their policies. We do not control refund decisions.
  • Price Changes: We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance.

Intellectual Property

Capsl, including its name, logo, design, and software, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of our service or branding without our written permission.

Termination

You may stop using Capsl and delete your account at any time from within the app. We may suspend or terminate your access if you breach these Terms or for operational or legal reasons. Upon termination, your right to use Capsl ceases. We may retain certain data as required by law or for legitimate business purposes, as described in our Privacy Policy.

Disclaimers

CAPSL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR USER CONTENT OR THE CONDUCT OF USERS. YOU USE CAPSL AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPSL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Indemnification

You agree to indemnify and hold harmless Capsl and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these Terms or any third-party rights.

Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in California. If you are in the European Union or other jurisdictions with mandatory consumer protection laws, your statutory rights may apply.

General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and Capsl regarding the service.

For app store purposes: If you use Capsl through the Apple App Store, you acknowledge that Apple has no obligation to provide maintenance or support for the app, and that Apple is not responsible for any claims relating to the app. If you use Capsl through the Google Play Store, you acknowledge that Google has no obligation to provide maintenance or support.
